If you've already paid or transferred money, goods or property to your child, the receiving parent or a third party for the child's benefit, you may be able to have your assessment changed. This is "Reason 5" under the Child Support (Assessment) Act.
This reason applies when:
- You've transferred money or assets as part of a property settlement for the child's benefit
- You've paid school fees, medical costs, or other expenses directly
- You've given property or goods to your child or their carer
- You've made payments to a third party (like a school) for your child
You can show evidence such as court orders, agreements, or bank statements that demonstrate the transfer of funds or property for the child's benefit.
John and Sarah's Story
During their property settlement, John agreed to transfer $50,000 directly into an education trust for his two children, plus pay their private school fees in advance for the next two years ($40,000).
Despite making these substantial payments for his children's benefit, his child support assessment was calculated as if he hadn't contributed anything extra.
John applied for a Change of Assessment under Reason 5. He provided the property settlement agreement showing the education trust transfer and receipts for the prepaid school fees. The Registrar determined that these transferred benefits should be considered and reduced his ongoing payments accordingly.
